A law passed in August only becomes real when someone is told what to do and by when. That happened today for Việt Nam’s new legal-dissemination statute: on 16 September 2026, Phó Thủ tướng Lê Tiến Châu signed Quyết định số 1790/QĐ-TTg on behalf of the Prime Minister, issuing the plan (Kế hoạch) for implementing Luật Phổ biến, giáo dục pháp luật số 12/2026/QH16. The plan’s stated aim is that from 1 March 2027 the law applies uniformly and in full across the country.
The law itself is easy to overlook. Its subject — phổ biến, giáo dục pháp luật, the state’s work of disseminating law and legal education — sounds like administrative housekeeping. It is not. Buried in Chương II is the first Vietnamese statute to treat social media accounts and AI assistants as regulated instruments of official legal communication, with conditions attached to both.
What the document is
Luật Phổ biến, giáo dục pháp luật số 12/2026/QH16 was passed by the Quốc hội khóa XVI at its Kỳ họp không thường lệ thứ Nhất on 23 August 2026 and signed by Chủ tịch Quốc hội Trần Thanh Mẫn. It runs to five chapters and 39 articles. Điều 38 brings it into force on 1 March 2027, at which point Luật Phổ biến, giáo dục pháp luật số 14/2012/QH13 ceases to have effect, save for the narrow transitional carve-out in khoản 2 Điều 39 for legal reporters (báo cáo viên pháp luật) whose dismissal procedures are already under way.
Today’s Quyết định 1790/QĐ-TTg is not a legislative instrument — it assigns work and deadlines. The substantive rules for organisations and individuals sit in the law and in the Government decree the plan orders up.
What changes compared to before
The 2012 law was not blind to the internet. Its Điều 11 already listed dissemination through mass media, electronic information pages and the internet. What it did not do was treat digital platforms, social networks and AI applications as a distinct form with its own rules.
The 2026 law does both. Điều 11 lists eight permitted forms of dissemination, and item 2 is “nền tảng số, mạng xã hội, ứng dụng trí tuệ nhân tạo” — digital platforms, social networks, AI applications — sitting alongside the traditional channels. Item 1 promotes the Cổng Pháp luật quốc gia to the head of the list.
Then Điều 13 devotes an entire article to that channel, in eight clauses:
- Khoản 1 defines the Cổng Pháp luật quốc gia as the national shared digital platform on law across sectors and fields. State agencies must standardise, update, share and manage the legal data within their remit on that portal. The portal is not new — it launched at phapluat.gov.vn on 31 May 2025 under Bộ Tư pháp, and Quyết định số 35/2026/QĐ-TTg of 13 July 2026 gave it an operating regulation effective 1 September 2026 — but this is the first time primary legislation names it.
- Khoản 2 makes dissemination through digital platforms, social networks and AI a duty of state agencies, not an option.
- Khoản 4 is the provision that drew the most press attention: dissemination of law on social networks must be done through an official account that has been identified and authenticated (tài khoản chính thức đã được định danh và xác thực).
- Khoản 5 governs AI. Its use must be controlled and updated against official state information and data sources; information must be verified before it is provided, with warning labels and corrections as required; and the organisation or individual that develops or operates the AI is responsible for the accuracy of the input data and of the information its system provides.
- Khoản 6 requires personal-data safety under the personal-data-protection law, and khoản 7 confirms that supervision, inspection and sanction apply here as elsewhere.
- Khoản 8 hands the detail to the Government.
Điều 9 adds a matching prohibition: it is forbidden to use information technology, artificial intelligence or other means to create or spread forged materials or to distort legal and policy content. The principles in Điều 5 require dissemination work to comply with the law on state secrets, cybersecurity, digital transformation, artificial intelligence and personal data protection — a cross-reference that lands on Luật Trí tuệ nhân tạo số 134/2025/QH15 (in force since 1 March 2026, detailed by Nghị định 142/2026/NĐ-CP) and Luật Bảo vệ dữ liệu cá nhân số 91/2025/QH15.
One further change is easy to miss: the law formally codifies truyền thông chính sách (policy communication) as a distinct activity. Điều 21 defines it as multi-directional information exchange about policy and draft legislation while it is being proposed and drafted, and khoản 4 lists digital platforms and social networks among its permitted channels.
Who it affects
The primary addressees are state bodies — ministries, People’s Councils and People’s Committees, courts, procuracies, the State Audit, the Mặt trận Tổ quốc and its member organisations. For them, Điều 12 and Điều 13 convert what was good practice into obligation: a dedicated legal section in a prominent position on the portal, suitable airtime in prime slots, and a verified official account for any social-media work.
But the reach is wider. Khoản 3 Điều 13 encourages organisations and individuals to take part in dissemination via platforms, social media and AI, and to exploit the legal data on the national portal. Anyone who accepts that invitation — a law firm running a TikTok channel, a legal-tech company shipping an AI chatbot, a publisher’s explainer podcast — steps inside Điều 13’s conditions. The AI accountability rule in điểm c khoản 5 is drafted by role, not by sector: it attaches to whoever develops or operates the system.
Practical implications
For businesses, the concrete items are three. First, account hygiene: any official channel used for legal content should be a verified, identified organisational account, not a staff member’s personal profile. Second, sourcing and verification: an AI assistant that answers legal questions needs a defensible pipeline back to official state sources, a pre-publication verification step, warning labels, and a correction path. Third, named responsibility: because liability sits with the developer or operator, contracts between a legal-content owner and an AI vendor should say which of them holds it.
For individuals, the practical effect is a signal about what to trust. From March 2027, legal information published by state bodies on social media should come from verified official accounts, and AI-generated legal content produced under this law should carry labels and corrections.
The timetable in Quyết định 1790/QĐ-TTg is the thing to watch. Bộ Tư pháp must submit the Government decree detailing the law in December 2026, and issue its own circular in time to take effect on 1 March 2027; Bộ Tài chính must issue the budgeting circular by the same date. Ministries and provinces review their existing rules and report to Bộ Tư pháp in January 2027, consolidated in February 2027. A national conference runs from Q4 2026 to Q1 2027, and the review of legal reporters is due before 20 April 2027.
Open questions
The operative detail is not in the law. Khoản 8 Điều 13 hands the entire digital-platform article to a Government decree that has not yet been drafted — which means the standard for “identified and authenticated”, the form of the warning labels, and the depth of the pre-publication verification duty are all unknown until December at the earliest.
Two boundary questions also remain. The law does not say where encouraged private participation ends and regulated activity begins: whether a lawyer’s ordinary explainer video is “phổ biến, giáo dục pháp luật” within Điều 13, or only organised programmes, is left open. And Điều 13 imposes duties on those who disseminate, not on the platforms that host them — there is no takedown or labelling obligation on a social network or an app store in this statute, which leaves enforcement of the Điều 9 prohibition to be run through cybersecurity and AI law instead.
