Most of Việt Nam’s technology legislation this year has been written by the Government: decrees on data exchanges, cybersecurity licensing, civil cryptography, data-analytics notification. Luật số 20/2026/QH16 comes from the other direction. It is a National Assembly act, it amends four separate laws at once, and almost everything it does is subtraction — conditions removed, procedures abolished, powers pushed downward.
On 10 September 2026 the Văn phòng Chủ tịch nước held a press conference in Hà Nội announcing the President’s promulgation orders (Lệnh) for 15 laws passed by the 16th National Assembly at its first extraordinary session. Luật số 20/2026/QH16 was one of them.
What the document is
The full title is Luật sửa đổi, bổ sung một số điều của Luật Tần số vô tuyến điện, Luật Viễn thông, Luật Giao dịch điện tử và Luật Chuyển giao công nghệ. The National Assembly passed it on 24 August 2026 at the Kỳ họp không thường lệ thứ Nhất of the XVI legislature, and it is signed by Chủ tịch Quốc hội Trần Thanh Mẫn. The text is short by the standards of a four-law amendment: six articles, one per amended law plus effect and transition.
Điều 5 sets two dates. The law takes effect on 1 March 2027, except for khoản 3 Điều 1 (the defence and security spectrum provision) and the whole of Điều 4 (technology transfer), which start on 1 October 2026.
The four laws being amended are the Luật Tần số vô tuyến điện số 42/2009/QH12, the Luật Viễn thông số 24/2023/QH15, the Luật Giao dịch điện tử số 20/2023/QH15 and the Luật Chuyển giao công nghệ số 07/2017/QH14 — each already amended several times, which the preamble dutifully lists.
The headline numbers, as presented by Bộ Khoa học và Công nghệ: 2 administrative procedures abolished, 47 business conditions cut, 4 simplified and 3 amended. In the spectrum field alone, 33 of 41 licensing conditions go, which the ministry estimates at a 50.86% cut in compliance cost and a 55.01% cut in processing time.
Why one law amends four
When Bộ trưởng Bộ Khoa học và Công nghệ Vũ Hải Quân presented the bill to the Ủy ban Thường vụ Quốc hội on 16 July 2026, the argument was consolidation rather than reform. Several of these relaxations were already running in practice under Government resolutions — Nghị quyết 66.10/2025/NQ-CP, 66.16/2026/NQ-CP, 66.17/2026/NQ-CP, 66.18/2026/NQ-CP — and under Nghị định 133/2025/NĐ-CP. Those instruments are transitional by nature; putting the same rules into the four parent laws is what makes them stable.
The bill therefore went through the “một luật sửa nhiều luật” shortened procedure, and the review committee insisted the drafters stay inside it: only mechanisms already approved by competent authority, no new policy smuggled in.
Spectrum: the telecom licence becomes the gate
Điều 1 rewrites thirteen points of the Luật Tần số vô tuyến điện, and the pattern is consistent. Where the old text imposed standalone conditions on a spectrum applicant, the new text asks a single question: does the applicant hold a licence to provide telecommunications services with network infrastructure?
That test now appears in Điều 20 khoản 2 (direct band assignment), in the re-licensing conditions of Điều 20a khoản 4, in Điều 22 điểm c khoản 1 (a band licence may not be extended beyond the term of the telecom licence), in Điều 23 điểm g (the band licence is revoked when the telecom licence is), and in Điều 24 điểm a khoản 2 (a transferee of spectrum rights must qualify for the corresponding telecom licence and inherit the transferor’s obligations). Four separate condition points are repealed outright: điểm a khoản 1 Điều 18a, khoản 2 Điều 19, điểm a khoản 3 Điều 20 and điểm đ khoản 1 Điều 22. For satellite orbital positions, Điều 21 khoản 2 keeps only the requirement of a launch plan that meets International Telecommunication Union bring-into-use deadlines.
Khoản 3 Điều 1 — one of the two provisions arriving on 1 October 2026 — deals with bands assigned in special cases to state enterprises directly serving defence and security. The first licence term rises from a maximum of 3 years to 5 years; Bộ Quốc phòng or Bộ Công an must prepare the đề án, consult Bộ Khoa học và Công nghệ and each other, and obtain the Prime Minister’s approval before Bộ Khoa học và Công nghệ issues the licence. The efficiency review moves from 3 months to 9 months before expiry, after which the Prime Minister may stop the scheme or continue it for up to 10 more years. Điều 6 handles the overlap: đề án submitted but not yet approved before 1 October 2026 fall under the new rule, while approved đề án and licences already issued stay under the law as it stood.
Điều 32 splits responsibility for radio operator certificates four ways: Bộ Xây dựng for maritime and aeronautical mobile services, Bộ Quốc phòng and Bộ Công an for those services in the defence and security domain, and Bộ Khoa học và Công nghệ for amateur radio. Throughout all four laws, references to “Bộ Thông tin và Truyền thông” are replaced with “Bộ Khoa học và Công nghệ” — the tidying-up of a ministry merger that happened in 2025.
Telecom: bankruptcy checks out, domain registrars come off the list
Điều 2 repeals điểm c khoản 1 Điều 36 of the Luật Viễn thông — the condition that an applicant not be in the process of dissolution or bankruptcy. The Government’s reasoning was blunt: the situation never arises in practice, and the underlying fact is already in state databases. The separate “phương án kỹ thuật, phương án kinh doanh” requirement is merged into one “kế hoạch kinh doanh và kỹ thuật”, and Điều 37 restates which of the remaining conditions a bidder must meet to enter a spectrum auction or beauty contest, adding that telecom financial obligations must be settled.
The change with the widest reach for internet businesses is quieter: khoản 4 điểm d of Điều 2 simply deletes the words “điều kiện hoạt động,” from khoản 4 Điều 48. That clause is the Government’s mandate to regulate providers of .vn domain name registration and maintenance services; with the phrase gone, the operating-condition regime for domain registrars disappears, consistent with the sector’s removal from the list of conditional investment and business lines. Oversight becomes post-hoc.
Điều 47 on infrastructure sharing is also reworked: sharing may now be arranged “thông qua hợp đồng hoặc văn bản khác”, sharing for defence and security tasks follows rules the Government will set period by period, and where operators cannot agree a sharing price, the dispute goes to hiệp thương giá under price legislation, with the competent state authority deciding other unresolved terms.
E-transactions and technology transfer
Điều 3 is two lines long but abolishes both of the law’s discarded procedures. The redrafted khoản 4 Điều 28 of the Luật Giao dịch điện tử tells the Government to regulate the issue, re-issue, suspension and revocation of trust-service licences — and no longer the renewal of a licence or a change to its content. Providers of trust services (digital signature certification, electronic timestamping, secure e-data authentication) will handle expiry through re-issue instead, and supply less paperwork the state already holds.
Điều 4, effective 1 October 2026, moves two powers under the Luật Chuyển giao công nghệ from the Prime Minister to Bộ Khoa học và Công nghệ: building and issuing the national science and technology market development programme (khoản 2 Điều 41), and leading on programmes, schemes and policies for technology import, market development and technology transfer, application and renewal (khoản 2 Điều 54).
Who is affected, and what to do
Mobile and fixed network operators get a shorter spectrum file but a tighter coupling: losing or letting lapse the network-services telecom licence now directly endangers band licences and any planned transfer of spectrum rights. Satellite operators face a single ITU-deadline test. Domain registrars for .vn move from licensing-style conditions into a post-check regime — a commercial opening, and a reason to expect inspection activity instead. Trust-service providers should plan for re-issue rather than renewal, and watch for the implementing decree that will set the new procedure. Amateur radio operators deal with Bộ Khoa học và Công nghệ; maritime and aviation crews with Bộ Xây dựng. Defence-linked state enterprises holding economic-use bands have a 5-year horizon and a 9-month review from 1 October 2026.
Because most of the law lands on 1 March 2027, the practical near-term task for regulated businesses is to track the decrees and circulars that must be redrafted in the meantime — the ministry has said 4 further procedures will be abolished and 78 amended or simplified at sub-law level.
Open questions
The review committee, chaired by Nguyễn Thanh Hải, made the obvious point at the July session: moving from pre-approval to post-inspection only works if the replacement tools exist, and it asked the Government to spell out the hậu kiểm method matching each condition removed. The law itself does not answer that; the decrees will have to.
Two other gaps stand out. The split effective dates mean the technology-transfer delegation and the defence-band rule operate for five months against parent laws otherwise unchanged, which will require careful reading of any file straddling the dates. And the removal of “điều kiện hoạt động” for domain registration services leaves open what a registrar must still satisfy — the residual duties sit in the Government’s remaining mandate under Điều 48 and in the decree that details it, neither of which has been reissued yet.
