Việt Nam has been moving official paperwork between ministries electronically since 2019, when the Trục liên thông văn bản quốc gia — the national document exchange platform — was inaugurated. What it has not had until now is a proper operating regulation for it: a single instrument saying who may connect, on what technical terms, what legal weight the documents carry, and what happens when the system goes down. Quyết định 43/2026/QĐ-TTg supplies that, and it takes effect on 1 November 2026.
What the document is
Quyết định 43/2026/QĐ-TTg is titled “Ban hành Quy chế quản lý, vận hành, khai thác, sử dụng Trục liên thông văn bản quốc gia” — issuing the Regulation on the management, operation, exploitation and use of the national document exchange platform. It was issued by the Thủ tướng Chính phủ on 16 September 2026 and signed on the Prime Minister’s behalf (KT. THỦ TƯỚNG) by Phó Thủ tướng Hồ Quốc Dũng, at the proposal of the Bộ trưởng, Chủ nhiệm Văn phòng Chính phủ.
The Quyết định itself is short — three articles — and its substance sits in the attached Quy chế, which runs to five chapters and 23 articles. Its legal bases are worth listing, because they show how much of the stack is new: Luật Tổ chức Chính phủ 63/2025/QH15, Luật Giao dịch điện tử 20/2023/QH15, Luật An ninh mạng 116/2025/QH15, Luật Chuyển đổi số 148/2025/QH15 (passed 11 December 2025, in force since 1 July 2026), plus Nghị định 68/2024/NĐ-CP on public-duty digital signatures, Nghị định 23/2025/NĐ-CP on electronic signatures and trust services, Nghị định 137/2024/NĐ-CP on state agencies’ electronic transactions, Nghị định 278/2025/NĐ-CP on mandatory data sharing across the political system, and Nghị định 30/2020/NĐ-CP on clerical work.
Điều 3 gives the platform an English name and abbreviation for the first time: Vietnam Document eXchange Platform (VDXP), defined as a “nền tảng số dùng chung quốc gia” — a national shared digital platform — managed and operated by Văn phòng Chính phủ.
What it changes
The predecessor regime is Quyết định 28/2018/QĐ-TTg of 12 July 2018, which governed the sending and receiving of electronic documents between agencies in the state administrative system. Under it, the Trục went live on 12 March 2019 and all 95 central and provincial bodies eventually connected. Notably, Quyết định 43/2026 contains no express repeal clause, and it actively preserves part of the old instrument: Điều 12 khoản 2 điểm a says that for bộ, ngành and địa phương, the document identifier structure continues to follow điểm b khoản 2 Điều 10 of Quyết định 28/2018.
What is new is the scope and the rigour. Four changes stand out.
Unique document IDs become mandatory. Điều 12 khoản 1: “Mỗi văn bản điện tử luân chuyển trên Trục liên thông bắt buộc phải có một Mã định danh văn bản duy nhất” — every electronic document moving across the platform must carry one unique identifier, for tracking, tracing and handling. For bodies outside the administrative system the regulation defines a new four-part structure: the issuer’s platform identifier, the year of issue, the document’s sequence number that year, and the document symbol.
Digitally signed documents displace paper. Điều 11 khoản 1 states that an electronic document signed in accordance with the electronic-transactions law has the same legal value as the original paper document, and replaces the sending and receiving of paper — except where sector-specific law says otherwise. The platform automatically checks and warns on documents that are unsigned or carry an invalid signature. Điều 3 khoản 7 introduces a companion concept, “văn bản điện tử toàn trình”: a document created, signed, issued, sent and received entirely electronically, with no parallel paper copy and not merely scanned from paper. Điều 5 khoản 5 makes these a priority and commits to a roadmap for minimising scanned documents.
Everyone connecting inherits a security baseline. Điều 20 requires both the operator and every connecting body to secure their systems to cấp độ 3 (level 3) under cybersecurity law, and to connect to the national cybersecurity monitoring system. Under Điều 6 khoản 5 and Điều 8 khoản 3, a would-be participant must run at least 10 working days of pilot connection on a test environment separate from production, then pass a cybersecurity assessment before going live. Văn phòng Chính phủ answers connection requests within 5 working days.
The door opens beyond the state. Điều 2 defines three groups: ministries, ministerial-level agencies and People’s Committees at all levels; other budget-using bodies that want to connect and qualify; and — new — other organisations with a need to use the platform. Businesses and cooperatives connect using their enterprise or cooperative registration number as their platform identifier (Điều 6 khoản 1 điểm b), and use public digital certificates rather than public-duty ones (Điều 7 khoản 2). Điều 5 khoản 2 requires that connections between state administrative agencies and businesses be voluntary, equal and safe.
Who it affects
Directly: every ministry, ministerial-level agency and People’s Committee, plus their subordinate units, and the IT teams running their Hệ thống quản lý văn bản và điều hành and LGSP platforms. Văn phòng Chính phủ carries fifteen separate duties under Điều 21. Three other ministries have named roles — Bộ Khoa học và Công nghệ for the Mạng truyền số liệu chuyên dùng backbone and the public-certificate gateway, Bộ Quốc phòng (Ban Cơ yếu Chính phủ) for public-duty digital certificates, and Bộ Công an for cybersecurity monitoring and incident response.
Indirectly but importantly: Vietnamese software vendors and system integrators who build document-management systems for government clients, and any enterprise that exchanges formal correspondence with state agencies. The regulation does not apply to documents containing state secrets (Điều 1 khoản 2), which stay on separate channels.
Practical implications
For agencies already connected, the binding date is not 1 November 2026 but 1 January 2027. Điều 23 khoản 1 gives bodies that completed their connection before the Quyết định takes effect until that date to review and upgrade their document-management systems and LGSP platforms to meet the new regulation. Bodies currently in pilot connection must comply before going live at all.
The operational detail is unusually specific, and worth reading as a checklist:
- Outage fallback. If a connection failure lasts more than 12 hours, agencies revert to paper — but Điều 18 khoản 4 requires that once service is restored, electronic versions of everything sent on paper during the outage must be pushed through the platform.
- Support SLAs. 24 hours to respond on service issues, 48 hours on connection and technical issues; 5 working days’ notice before planned maintenance; a 2-hour window for the operator to notify an agency of a detected connection loss (Điều 9 khoản 2).
- Urgent documents. The platform raises an automatic alert if a packet marked khẩn or above sits unreceived for 30 minutes (Điều 19 khoản 1).
- Patching. Security Server patches and upgrades must be applied within 7 days of the operator’s notice; configuration or network changes need 3 working days’ advance notice (Điều 17).
- Account hygiene. An administrator account idle for 45 consecutive days triggers an SMS or email warning; 15 days later the platform locks it automatically. Passwords must change at least every 6 months. Agencies must audit their delegated accounts at least once a quarter and report unfamiliar accounts to Văn phòng Chính phủ (Điều 16, Điều 22 khoản 1 điểm h).
- Reporting. Quarterly reports on usage, document volume and problems, via Văn phòng Chính phủ’s reporting system under Thông tư 05/2025/TT-VPCP.
Document handling itself becomes stateful. Điều 14 khoản 3 defines ten status codes that must be synchronised back to the platform as soon as they change — including Đã đến, Tiếp nhận (vào sổ), Đang xử lý, Hoàn thành xử lý, Từ chối tiếp nhận, Thu hồi, Quá hạn xử lý, Cập nhật and Thay thế. Điều 15 builds a recall and correction workflow on top: a sender can withdraw a document the recipient has not yet booked in, but after booking, withdrawal needs the recipient’s confirmation; refusals must carry a stated reason; and updates or replacements are automatically linked to the original document’s identifier with version history retained.
One forward-looking provision is easy to miss. Điều 21 khoản 12 directs Văn phòng Chính phủ to apply digital technologies — expressly naming artificial intelligence, big data, digital twins, cloud computing, edge computing, IoT and blockchain — to running the platform. Điều 4 khoản 2 điểm c already lists a phân hệ trợ lý ảo, a virtual assistant subsystem, among the platform’s components.
Open questions
The absence of a repeal clause is the main one. Quyết định 28/2018/QĐ-TTg is referenced as live law for identifier structure, so it is clearly not wholly superseded, but the new Quy chế covers much of the same operational ground. Which of the 2018 provisions survive, and how the two instruments interact after 1 November, is left to practice or to guidance from Văn phòng Chính phủ.
Second, participation by the third group — private organisations — is real but undefined in scope. Điều 21 khoản 13 tasks Văn phòng Chính phủ with issuing guidance on the phạm vi and lộ trình for how those bodies may use the platform to exchange documents with state agencies. Until that guidance appears, a company reading Điều 2 khoản 3 cannot tell what it would actually be able to send.
Third, the regulation sets a cấp độ 3 security floor for every connected system but does not say who pays for the upgrade, or what happens to an agency that misses the 1 January 2027 deadline. Điều 9 khoản 4 gives the operator power to disconnect a body whose infrastructure or security is inadequate, with reconnection only after remediation and assessment — which is the enforcement mechanism, but a blunt one for a network that every ministry depends on daily.
